1. Service Description

Kablewy Voice Assistant ("the Service") is an AI-powered phone assistant operated by Kablewy ("we," "us," "our"). When you call our phone number, you are connected to an artificial intelligence assistant that can answer questions, perform tasks, and carry out actions on your behalf.

The Service uses artificial intelligence (AI) to generate voice responses. You are interacting with an AI system, not a human being. Voice responses are generated in real time by OpenAI's Realtime API. Phone connectivity is provided by Twilio. The Service is hosted on Cloudflare.

2. AI Disclosure

In accordance with applicable federal and state laws, including but not limited to the FCC's February 2024 declaratory ruling and California AB 2905:

• All voice responses you hear during a call are generated by artificial intelligence.
• The AI assistant is not a licensed professional and does not provide medical, legal, financial, or other professional advice.
• AI-generated responses may contain errors or inaccuracies. You should independently verify any important information.
• The AI voice is synthetic and does not represent any real person.

3. Eligibility and Registration

To use the Service, you must:

• Be at least 18 years old or the age of majority in your jurisdiction.
• Register with a valid phone number and verify it via SMS.
• Agree to these Terms of Service and our Privacy Policy.

4. SMS and Messaging Terms

Program name: Kablewy Voice Assistant

By providing your phone number and opting in, you consent to receive SMS messages from us, including:

• Verification codes for account registration and login.
• Service notifications and updates.
• Opt-in confirmation messages.

Message frequency varies based on your use of the Service.

Message and data rates may apply. Check with your carrier for details.

To opt out of SMS messages, reply STOP to any message from us. You will receive a confirmation that you have been unsubscribed. After opting out, you will no longer receive SMS messages from us.

For help, reply HELP to any message from us or contact us at the information provided below.

Your mobile phone number and information will not be shared with or sold to third parties or lead generators for marketing or promotional purposes.

5. Call Recording and Transcription

When you call the Service:

• Your voice audio is streamed in real time to OpenAI for AI processing. Audio is processed as transient data and is not permanently stored by us.
• Calls may be transcribed for quality improvement and to provide you with conversation history.
• By using the Service, you consent to the processing of your voice audio and the generation of transcripts.

If you are located in a two-party consent state (including California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, New Hampshire, Oregon, Pennsylvania, and Washington), your continued use of the Service after hearing the AI disclosure at the beginning of each call constitutes your consent to audio processing and transcription.

6. Consent

By registering for and using the Service, you consent to:

• Interacting with an AI-powered voice assistant.
• The processing of your voice audio as described in Section 5.
• Receiving SMS messages as described in Section 4.
• The collection and use of your data as described in our Privacy Policy.

You may revoke your consent at any time by discontinuing use of the Service and contacting us to request account deletion.

7. Acceptable Use

You agree not to use the Service to:

• Engage in any illegal, fraudulent, or harmful activity.
• Harass, threaten, or abuse the AI system or other users.
• Attempt to extract, reverse-engineer, or circumvent the AI system.
• Generate content that violates OpenAI's usage policies.
• Impersonate any person or entity.
• Transmit malicious content or attempt to compromise the Service.

We reserve the right to suspend or terminate your access for violations of these terms.

8. Third-Party Services

The Service relies on the following third-party providers:

• OpenAI — AI voice processing and response generation, subject to OpenAI's Usage Policies.
• Twilio — Phone and SMS connectivity, subject to Twilio's Terms of Service.
• Cloudflare — Hosting and infrastructure.

Your use of the Service is also subject to the terms and policies of these providers.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• AI-generated responses will be accurate, complete, or reliable.
• The Service will be uninterrupted, timely, or error-free.
• The Service will meet your specific requirements.

The AI assistant is not a substitute for professional advice. Do not rely on AI responses for medical, legal, financial, or emergency decisions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KABLEWY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

11. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated terms.
